BP British Petroleum filed an appeal of the Oil Spill Claims Settlement entered in the Deepwater Horizon case. The Appeal was from a District Court Order on the Settlement Agreement and was heard by the Fifth Circuit Court of Appeals. BP hired a prominent appeals lawyer who argues that payments under the agreement are excessive. At around 16:00 minutes, the Oil Spill claimants' lawyer then argues that BP agreed to the terms of the settlement. At around 32:00 minutes, finally,  the claims administrator argues he is following the agreement and will do what the Court orders him to do. The Oil Spill Claims Appeal had Oral Arguments on July 8, 2013. Video and audio are from official Court records. Approximate viewing time is 45 minutes.

Just spent the rainy afternoon studying the latest official report on the status of BP Oil Spill Settlement claims, denial of claims, and appeals of claims (by BP) or denials of claims (appealed by victims). There are over 10,000 claims filed per month (see graph below). Between 2,000 and 4,000 claims are paid each month (see graph below). 3.5 Billion in claims to date.

Meanwhile here are the latest numbers:

175,049 Claim Forms since the Deepwater Horizon Economic and Property Damages Settlement Program opened.

9,152 have been denied. "As of June 10, 2013, we have issued 44,236 Eligibility Notices with Payment Offers totaling over $3.5 billion. As of that date, we also have made over $2.44 billion in payments on . . .

BP Oil Spill Claims Tampa Hillsborough - Pinellas Update

BP Oil Spill Claims Attorney notes that Tampa (Hillsborough County) now has plans to sue BP for Oil Spill losses, according to the St Petersburg (Pinellas County) Times. They reported, "Hillsborough County commissioners voted unanimously Wednesday to file suit over the county's claim that it suffered nearly $43 million in losses — from hotel, gas, sales and other tax and fee receipts — as a result of the spill." 

Experts have been hired, "To prepare Tampa's claim, forensic accountants found a "measurable effect" from the spill after scrutinizing more than a dozen sources of city revenue . . . when the city's claim was filed in January. Those revenues covered everything from property and sales taxes to taxes on city utilities and communication services to street car, golf course and parking revenues." 

Some businesses were stonewalled when they tried to pursue claims as the BP Oil Spill Claims video below shows. Now some businesses will be pursuing claims with professional help.

One media source noted, "In the months after the Deepwater Horizon oil rig exploded 300 miles off Florida's coast in April 2010, hotel and restaurant owners, fishermen and shopkeepers kept a grim vigil, waiting to see whether the millions of gallons of spilled oil would taint the state's beaches and harm its seafood." The Feeding Frenzy report also noted,, "In December, U.S. District Judge Carl Barbier in New Orleans gave final approval to a $7.8 billion partial class-action settlement providing for economic and property damages from the spill, including those in Florida. BP separately agreed to pay $4.5 billion in penalties and pleaded guilty to felony misconduct in the disaster, which cost 11 lives. Barbier now is presiding over a trial to determine whether BP was grossly negligent, with another $17 billion in potential penalties at stake."

The writer recognized, "With the new guidelines, thousands of firms may qualify if they fall within designated coastal zones and show a 2010 drop in revenue after the disaster, with a rebound in 2011. But the window to collect damages from the largest oil spill in U.S. history is closing — economic and property damage claims must be filed by April 2014. "

The article concluded, "As of Feb. 10, in the third phase of payouts, the Deepwater Horizon Claims Center had issued 26,608 eligibility notices with payment offers totaling more than $2 billion throughout the gulf states. The center had also completed more than $1.43 billion in payments on 19,530 claims. "

The BP Settlement Agreement provides, in part: 

CAUSATION REQUIREMENTS FOR BUSINESSES ECONOMIC LOSS CLAIMS 

I. Business Claimants for Which There is No Causation Requirement 

1) If you are a business in Zone A, you are not required to provide any evidence of causation unless you fall into one of the exceptions agreed to by the parties, and listed in footnote (1). 

2) If you are a “Landing Site,” or “Commercial Wholesale or Retail Dealer A,” or “Primary Seafood Processor,” as set forth in “Seafood Distribution Chain Definitions,” you are not required to provide any evidence of causation. 

3) If you are in Zone A, B or C and you are a “Commercial or Wholesale or Retail Dealer B,” or a “Secondary Seafood Processor,” or a “Seafood Wholesaler or Distributor,” or a “Seafood Retailer,” as set forth in “Seafood Distribution Chain Definition,” you are not required to provide any evidence of causation. 

4) If you are in Zone A or Zone B, and you meet the “Tourism Definition,” you are not required to provide any evidence of causation. 

5) If you are in Zone A, B or C, and you meet the “Charter Fishing Definition” you are not required to provide any evidence of causation.

Florida Oil Spill Attorney Speaks

We have previously written about the intense effort by Steve Yerrid to help Floridians victimized by the oil spill. Here is a Letter he recently wrote:

For all the criticisms of former Gov. Charlie Crist, no one can attack how he handled the BP oil spill. He made virtually daily efforts to hold that international corporate conglomerate responsible for the worst man-made disaster in our history.

I was honored to be appointed special counsel to the governor shortly after the spill. Along with him, I personally spent hundreds of hours preparing, strategizing and documenting Florida's claim against this corporate wrongdoer and its accomplices, Halliburton and TransOcean. It is a shame that the massive and catastrophic harm caused to this generation of Floridians — and generations to come — remains unpaid.

My career has been successful beyond anything I could have imagined. So I had the ability, the honor and the privilege to represent the people of Florida pro bono not for just the nearly 1,000 hours I personally spent, but the substantial costs I incurred and personally paid for in trying to ensure our citizenry would receive appropriate reparations and restitution for this man-made tragedy. The harm was not just huge economic losses to our state and its people, but ecological and environmental damage that we have yet to fully appreciate or even understand.

As my term neared its end on Dec. 31, 2010, I made several attempts to reach out to Gov.-elect Rick Scott so that the transition to my successor legal representative would be seamless and the massive claims by the state would not fall between the cracks. I never received the courtesy of a reply, much less an acknowledgement of my effort as special counsel.

Frankly, I did not expect Scott to thank me — he is simply too friendly with corporate America to thank a trial lawyer, regardless of the services rendered and even though the beneficiaries of my work were the people of Florida.

That is regrettable, but what has happened in these many intervening months is simply unacceptable. While Florida attempts to operate in the face of a huge deficit with underfunded programs and underpaid staff, Scott has elected to make nice with the corporate wrongdoers and accept paltry token payments. There is no logical explanation.

I estimated the state could recover upward of $2 billion for the multifaceted claims that could rightfully be asserted. Several months back, Scott accepted $30 million from the wrongdoers, appeared at a joint news conference and profusely thanked them for their "payment." It is now July 2011, and the billion-dollar-plus bill owed to Florida remains unpaid. The reason? Scott does not want corporate America to pick up the check even when the wrongdoing is clear, the damages apparent and the need for payment never greater.

Anticipating Scott's response, I am not against corporate America. Our country's corporations have done enormous good and provided countless jobs through generations of Americans.

It is actually much simpler than all that. When a corporation does wrong and inflicts enormous damages and harm, it must be held accountable — just like any individual. It is ironic that Scott fails to comprehend that basic notion, especially given his own experience when the corporation he headed defrauded Medicare and paid one of the largest fines ever imposed in U.S. history.

That may explain his repeated condemnation of trial lawyers, who have also made significant and huge contributions to our country, but it fails to offer any explanation for his profound inaction regarding the BP oil spill and its aftermath.

Scott needs to do the job expected of him by his employers — Florida's citizens and taxpayers. Unfortunately, I believe the future is fairly certain, given his announced and demonstrated agenda. Sooner or later Scott will get $200 million, maybe $250 million, from BP and the corporate gang of wrongdoers. He will hold a big news conference, probably arm-in-arm with the people who so damaged our shores, our sea and our people.

When that day comes, know that he will be getting 10 cents on the dollar. In light of the egregious circumstances of what has occurred, any experienced trial lawyer would scoff at such chump change.

No one from this governor's administration has sought access or even taken one minute to look at the wealth of materials and the huge amount of work product that was assembled on behalf of the people of Florida to pursue our claim. What a terrible shame.

We are not sure who the Governor is protecting, but it is not the people of Florida.

Florida's Oil Spill Lawyer | Appointment Not Renewed | Breaking News

Who Represents Florida Now?
Florida has lost a champion for the victims of the BP Oil Spill. Steven Yerrid was not reappointed by the Governor as Florida's go-to guy on the Gulf Oil Spill.

"Lawyers say there are billions in damage claims unsettled in Florida, and the attorney appointed by the previous governor to represent the state's interest says Scott won't respond to his calls and letters about pursuing the state's claims against BP."

"I think it would be in the billions of dollars," Yerrid said. "It would have a substantial, if not a mitigating effect on our deficit. The money is there, there's a $20 billion fund that isn't close to being exhausted, and my question is, what are we doing about it?".

"This administration has decided not to retain the services of Mr. Yerrid. We will be pursuing claims in the future with the intent not to have to litigate," said Governor's spokeswoman Amy Graham.
